Right to Appeal limitation Extended to 60 days as per new Amendment

The Amendment in limitation period extending the time period of Appeal to 60 days came in the knowledge of the Supreme Court  during the review hearing on the election of KPK and Punjab. Attorney General while representing Government brought new law in the knowledge of the Chief Justice, astonished by the fact that the law not only passed but came into effect immediately with President Assent. It shooked the Chief Justice, that the law facilitates the way to remove the disqualification upon Nawaz Sharif and Jahangir Tareen. The resource confirms that  Prime Minister Shahbaz Shareef himself took the bill for the assent of the President. The chief Justice upon knowing replied, ” let us understand the Law”

Under Article 184, a right of appeal was granted for a time against all past decisions. The revisional appeal will be decided by a bench larger than the bench which gave the earlier decision. The time period for revisional appeal has been increased to 60 days

The court adjourned the hearing of the Punjab election review case.

After curtailing the powers of the chief justice of Pakistan, the government on Friday got passed the “Supreme Court Review of Judgments and Orders Bill 2023”  regarding the right of appeal in suo motu cases through the Senate

The ongoing tussle between parliament and the judiciary become never ending. Parliament unaware of power of indepence of Judiciary which gives the right and authority to annulled and void on finding unconstitutional is passing the Laws.

The bill was presented by (PML-N) member Irfan ul Haque Siddiqui was passed by a majority of 32 votes despite the opposition’s uproar.

The bill that aims to facilitate and strengthen the SC in the exercise of its powers to review its judgments and orders was earlier passed by the NA on April 14.
