Islamabad: The Federal Government has designated specific courts; District Judges to hear cases under the recently enacted Lawyers Welfare and Protection Act, 2023, a significant legislative measure aimed at ensuring the welfare and protection of advocates across Pakistan.
The Act provides a comprehensive legal framework to address acts of violence against lawyers and enhance their professional security. It explicitly defines categories of “acts of violence” against advocates, making such offenses punishable with strict penalties.
Under the provisions of the Act:
- The offense of committing violence against an advocate carries a punishment of up to three years of imprisonment, a fine of up to one lakh rupees, or both.
- Repeat offenders may face up to five years of imprisonment, a fine of two lakh rupees, or both.
- Violence against lawyers is categorized as a non-bailable offense, emphasizing the gravity of such acts.
In line with this law, special courts have been designated to exclusively handle cases under the Act, ensuring swift and focused judicial proceedings. This move underscores the government’s commitment to protecting legal professionals and upholding the integrity of the justice system in Pakistan.
Legal experts and bar associations have welcomed the establishment of special courts and the legal safeguards provided under this Act, considering it a landmark step toward addressing longstanding concerns of the legal community. However, effective implementation will be critical to achieving its intended goals.
