Judicial Controversy Unfolds as Justice Naqvi Faces Misconduct Allegations

In a significant development, a reference has been filed against Justice Mazahar Ali Akbar Naqvi in the Supreme Judicial Council (SJC) on allegations of possessing assets beyond means. Filed by lawyer Mian Dawood, the reference claims assets totaling Rs3 billion and calls for an inquiry into potential misconduct under Article 209 of the Constitution.

The reference accuses Justice Naqvi of violating the Code of Conduct for judges, citing instances of alleged misuse of power to facilitate his children studying abroad and financial gains from Zahid Rafique, the owner of Future Holdings. It also raises questions about the ‘legalization’ of income through property sales, specifically mentioning Allied Plaza.

Adding to the complexity, the reference refers to a past controversy involving the granting of bail, with former Chief Justice Asif Saeed Khosa issuing strictures. Additionally, it alleges a nexus between Justice Naqvi’s family and individuals seeking favorable decisions in criminal cases in Lahore High Court and Supreme Court, claiming hefty amounts were demanded in return.

In response, Justice Naqvi has sought the recusal of three SJC members, including Chief Justice Qazi Faez Isa, citing bias and challenging the legality, propriety, and transparency of the proceedings. His preliminary reply contends that the charges are politically motivated.
