National Assembly Passed resolution against SC Order on Election Commissioner – is it Violation of Article 68?

Today, at 3 20 pm PMLN party member Khalid Hussain Magsi submitted a resolution against SC Order annulling Election Commissioner’s Decision to extend elections has been passed by the National Assembly. PTI Member Mohsin Lagari condemned and protested against resolution. The resolution intends to declare SC order to be inexecutable, further it states to form a full bench while deciding the same matter.

The resolution states that this Assembly objects CP 5/2023 and 3 bench Verdict and obliged Prime Minister and Cabinet not to implement such unlawful and unconstitutional order, further the resolution reads for the wrongful interpretation by the supreme court while apprehending Article 63 A of the Constitution of Pakistan in the matter and asserts to form full bench over the matter.

Article 68 of the Constitution strictly restrains parliamentarians from discussing with respect to the conduct of any judge of the Supreme Court or even high court which if done so amounts to contempt of Court. Such Conduct has been declared contemptuous in the Past as found under PLD 1988 SC 823 where members of Parliamentarian having made offending speeches about the Judiciary and expunction of such speeches from the record by the speaker at the fag-end of the session has not defence to an action under Action 204 of the Constitution of Pakistan.

This war between the Executive and Judiciary has become a never-ending game. PMLN has taken the battle of Constitutional Supremacy to the Parliament Supremacy over another ground, what the nation awaits is whether its National Assembly members supporting the resolution will be punished Under Article 204 of Contempt of Act or not.
