Significance of Precedents

A court decision known as precedent is used as a guide when considering subsequent cases containing the same or similar facts, or comparable legal issues, although it is only legally binding in a hierarchical Court.

More than any other legal philosophy, courts in the Common Law system rely on the doctrine of “precedent” when making decisions. Even though it plays a significant role in Pakistani law, this doctrine’s application has so far done a great deal to close the gap. Although In Pakistan, the percentage of implementation based on precedent cases has not yet been found. Are the Supreme Court’s decisions enforceable against the Supreme Court itself? Are the Supreme Court’s rulings binding on the lower courts?
