Requirements for Sindh High Court Enrollment – Sindh Bar Council

If you are a legal professional seeking enrolment as an advocate of the Sindh High Court, it is essential to follow the prescribed procedures and submit the required documents. Below is a comprehensive guide to the Sindh High Court Enrolment Process as per the Sindh Bar Council guidelines.

1. Application Submission

2. Affidavit

  • Affidavit Requirements:
    The affidavit must be sworn on Rs. 200/- non-judicial stamp paper before an Oath Commissioner.
  • Contents of the Affidavit:
    The affidavit should include the following declarations:

    • The applicant fulfills the requirements of Section 27(a) of the Legal Practitioners and Bar Council Act, 1973.
    • The applicant has never been involved in any criminal proceedings or proceedings for professional misconduct in Pakistan or abroad.
    • During the applicant’s period of legal practice, he/she was not engaged in any business, profession, vocation, or service, ensuring continuous active practice in the legal profession.
    • The list of cases provided by the applicant is accurate, and these cases were personally handled by the applicant in the courts.

    The affidavit must be attested by a Justice of Peace.

3. Two Character Certificates

  • Character Certificate Requirements:
    • Two certificates are required from senior advocates who have been enrolled with the Sindh Bar Council for at least ten years.
    • The senior advocate must affirm that the applicant is a fit person to be admitted as an advocate of the High Court.
    • The certificate must include the date of enrolment and the Bar Council registration number of the issuing advocate.
    • The issuing advocate must not have any dues outstanding with the Sindh Bar Council.

4. List of Ten Cases

  • Case Requirements:
    • Provide a list of ten cases handled by you in your practice, with the following details:
      • Sr. No.
      • Case No.
      • Name of Parties
      • Court Name
      • Detailed facts of the case
      • Law involved
      • Vakalatnama (with position/status of the case)
      • Certified copy of the case orders or proceedings
  • Vakalatnama:
    Along with the case list, submit the Vakalatnama for all ten cases. At least five of these cases should include:

    • Orders with your name mentioned,
    • Your involvement in chief or cross-examination,
    • Your name appearing in the court diary.
  • Important Note:
    • Cases should be from the year after your enrolment date. For example, if you enrolled in 2023, you cannot submit cases or vakalatnamas from 2022.

5. Sindh Bar Council Dues

  • Clearance of Dues:
    Ensure that all Sindh Bar Council dues are cleared for the current year before submission.

6. Bar Association Clearance Certificate

  • Certificate Requirement:
    Submit a clearance certificate in original from the Karachi Bar Association (or the relevant Bar Association) for the current year.

7. Photographs

  • Photographs Required:
    Submit six passport-sized photographs in court dress. These photos must be recent and meet the Bar Council’s specifications.

8. Payment Details

  • Total Payment:
    A total of Rs. 12,000/- is required to be paid via Pay Orders. The breakdown is as follows:

    • Rs. 7,000 – Payable to the Sindh Bar Council.
    • Rs. 3,000 – Payable to the Building Fund.
    • Rs. 1,000 – Payable for the ID Card.
    • Rs. 1,000 – Payable to the Pakistan Bar Council.
  • Payment Mode:
    Payments should be made via Pay Orders or Challan in favor of the respective entities.

    • Total Payment: Rs. 12,000/-
    • (Note: The exact fee may vary annually, so verify with the Bar Council before payment).

9. Enrollment Form

  • Submission of Enrollment Form:
    Fill out the enrollment form and submit it along with all required documents. The form can be obtained from the Sindh Bar Council office or online.

10. Submission Deadline

  • Exact Two-Year Requirement:
    Documents should only be submitted exactly two years after your initial enrolment as a lawyer. For example, if you were enrolled on November 17, 2022, your submission should be made on November 18, 2024, not earlier.

12. Post-Submission Process

    If there are no objections, you will be enrolled within 10 days at a minimum or within 3 months at maximum.

13. Post-Enrolment Procedure

  • After receiving your certificate and Sindh Bar Council card, immediately apply for Sindh High Court membership.
